Power to make regulations SCHEDULE 5 LAWS OF MALAYSIA Act 740 VETERANS ACT 2012 An Act to establish the National Veterans Council, to provide for the registration of veterans and veterans associations, and to provide for matters connected therewith. [15 October 2015, P.U. (B) 398/2015] ENACTED by the Parliament of Malaysia as follows: PART I PRELIMINARY Short title and commencement 1. (1) This Act may be cited as the Veterans Act 2012. (2) This Act comes into operation on a date to be appointed by the Minister by notification in the Gazette. Interpretation 2. In this Act, unless the context otherwise requires— “veteran activity”” includes the following activities: (a) organizing any welfare and socioeconomic programs for veterans and their dependants; (b) organizing any campaign in relation to the interests of veterans and their dependants; 6 Laws of Malaysia ACT 740 (c) raising funds, donations or monetary contributions for the welfare of veterans or members of any veterans association; (d) organizing any appreciation and acknowledgement programs for veterans; (e) organizing or promoting any awareness programs for the interest and benefit of veterans; and (f) participating in conferences, meetings, congregations or programs in relation to veterans held in Malaysia or elsewhere; “Department” means the Malaysian Armed Forces Veterans Affairs Department; “Council” means the National Veterans Council; “Minister” means the Minister charged with the responsibility for defence; “Registrar” means the Registrar appointed under section 7; “association” means any organization, society, association, club or body consisting of at least fifty percent membership amongst former members of the Malaysian Armed Forces or the Commonwealth Forces who have served in Malaysia; “veterans association” means any association which is registered under this Act; “veteran” means a Malaysian citizen who has served full time and has not been retired or discharged from service on grounds of misconduct in any of the following Forces: (a) regular forces of the Malaysian Armed Forces; (b) volunteer forces mobilized full time by the Malaysian Armed Forces regardless of length of service; (c) Force 136; Veterans 7 (d) British Forces who served in Malaya, Malaysia or Singapore; and (e) Sarawak Rangers. PART II ESTABLISHMENT AND FUNCTIONS OF THE NATIONAL VETERANS COUNCIL National Veterans Council 3. (1) A body to be known as the National Veterans Council shall be established for the purpose of this Act. (2) The Council shall consist of the following members: (a) the Minister who shall be the Chairman; (b) the Secretary General of the Ministry of Defence who shall be the Deputy Chairman; (c) the Director General of the Malaysian Armed Forces Veterans Affairs Department who shall be the Secretary; (d) the Assistant Chief of Staff (Personnel Services) of the Malaysian Armed Forces Headquarters; and (e) not more than five persons, at least two of them are veterans who have the experience, knowledge or expertise in matters relating to veterans’ affairs to be appointed by the Minister. (3) A member of the Council appointed under paragraph (2)(e) shall, unless he sooner resigns or vacates his office or his appointment is sooner revoked, hold office for a term not exceeding two years and is eligible for reappointment for a term not exceeding two consecutive terms. Functions of the Council 4. (1) The functions of the Council are as follows: 8 Laws of Malaysia ACT 740 (a) to formulate policies and plans of action relating to veterans’ affairs; (b) to oversee the implementation of policies and plans of action relating to veterans’ affairs; (c) to coordinate and monitor the implementation of policies and plans of action relating to veterans with the relevant ministries, government agencies, bodies or organizations and the private sector; (d) to advise and make recommendations on the formulation of any legislation or amendment of any existing legislation in order to secure the welfare and interests of the veterans; (e) to advise the Government on the issues of veterans’ affairs including the developments at the international level; (f) to act as the monitoring body for all veterans associations in Malaysia; and (g) to perform any other functions as directed by the Minister for the proper implementation of this Act. (2) The Council shall have power to do all things expedient or reasonably necessary for, or incidental to, the performance of its functions. (3) The Council shall regulate its own proceedings. Allowances 5. The members of the Council appointed in subsection 3(2) may be paid such allowances as the Minister may determine. Council to be assisted by the Department 6. The Council shall be assisted by the Department in the performance of its functions and the exercise of its powers under this Act. Veterans 9 PART III REGISTRATION OF VETERANS Registrar 7. The Director General of the Malaysian Armed Forces Veterans Affairs Department shall be the Registrar. Register of veterans 8. (1) The Registrar shall keep and maintain or cause to be kept and maintained a register of veterans in such manner and form as may be prescribed. (2) Any register of veterans kept and maintained by the Ministry of Defence and the Department immediately before the coming into operation of this Act shall, on the coming into operation of this Act, be deemed to be registers kept and maintained under subsection (1) and shall be deemed to form part of such register of veterans. Application for registration 9. (1) An application for registration as a veteran shall be made in writing to the Registrar. (2) Every application under subsection (1) shall be accompanied by such document or information as may be prescribed. Power of Registrar to require applicant to provide additional document or information 10. (1) The Registrar may, in relation to any application made under section 9, require the applicant to provide such additional document or information within the time as may be specified by the Registrar. 10 Laws of Malaysia ACT 740 (2) Where the applicant fails to provide the additional document or information required by the Registrar under subsection (1) within the specified time or any extended time as may be specified by the Registrar, the application is deemed to have been withdrawn and shall not be proceeded with by the Registrar, but without prejudice to a fresh application being made by the applicant. Registration or refusal to register 11. (1) After considering an application under section 9 and any additional document or information provided under section 10, the Registrar may approve or refuse the application. (2) Where the application is approved, the Registrar shall register the applicant by entering the applicant’s particulars in the register of veterans referred to in section 8. (3) Where the application is refused, the applicant may appeal to the Minister whose decision shall be final. (4) Notwithstanding subsection (1), and sections 9 and 10, any person who immediately before the coming into operation of this Act is registered as a veteran with the Jabatan Arah Rekod dan Pencen Markas Angkatan Tentera Malaysia shall, on the coming into operation of this Act, be deemed to be a veteran registered under this Act. Issuance of Veteran Card 12. (1) The Registrar shall issue to a person who is registered as a veteran under section 11 a Veteran Card. (2) The Veteran Card issued under subsection (1) shall be conclusive evidence for all purposes that the person has been duly registered as a veteran under this Act. (3) Any person to whom a Kad Bekas Tentera has been issued by the Jabatan Arah Rekod dan Pencen Markas Angkatan Tentera Malaysia immediately before the coming into operation of this Act and Veterans 11 deemed to be a veteran under subsection 11(4) shall be issued a Veteran Card under this Act. PART IV REGISTRATION AND SUPERVISION OF VETERANS ASSOCIATIONS Application to be registered to carry out veteran activity 13. (1) No association shall carry out any veteran activity unless it is registered as a veterans association under this Act. (2) An association which intends to carry out any veteran activity shall apply to the Registrar for registration under this Act in such manner and form as may be prescribed. (3) The Registrar may require the applicant to provide any document or information as may be prescribed. Registration of veterans association 14. (1) After considering an application by an association under section 13, the Registrar may approve or refuse the application for registration. (2) Without prejudice to the generality of subsection (1), if the Registrar is satisfied that such association is a non-political organization for the advancement of the welfare of veterans and that the constitution of such association contains provisions for such matters as set out in the Schedule, the Registrar shall approve the registration of such association as a veterans association under this Act. Register of veterans associations 15. (1) Where the application for registration is approved by the Registrar, he shall register the association as a veterans association in 12 Laws of Malaysia ACT 740 the register of veterans associations to be kept and maintained by the Registrar in such manner and form as may be prescribed. (2) The Registrar may impose any conditions, including the payment of any fees, as he deems fit upon the registered veterans association. (3) A veterans association registered under this Act shall, if its constitution does not contain the matters set out in the Schedule, amend its constitution within twenty-one days after its registration to include such matters. Certificate of registration 16. (1) The Registrar shall issue to a veterans association registered under section 15 a certificate of registration in the prescribed form. (2) A certificate of registration, unless proved to have been subsequently revoked, shall be conclusive evidence for all purposes that the association has been duly registered by the Registrar as a veterans association under this Act. Association registered under the Societies Act 1966 17. Any association registered under the Societies Act 1966 [Act 335] on the date of coming into operation of this Act shall cease to be registered under the Societies Act 1966 and shall within three months thereof apply to the Registrar to be registered under this Act as a veterans association to carry out any vetera
