Amendment of Part I of the Tenth Schedule to the Federal Constitution 4 Laws of Malaysia ACT 622 Capitation Grant 5 LAWS OF MALAYSIA Act 622 CAPITATION GRANT ACT 2002 An Act to amend the provisions of Part I of the Tenth Schedule to the Federal Constitution. [1 January 2002] WHEREAS by Clause (2) of Article 109 of the Federal Constitution it is provided that Parliament may from time to time by law vary the rates of the capitation grant appearing in Part I of the Tenth Schedule to the Constitution: AND WHEREAS pursuant to Clause (4)(b) of Article 159 of the Federal Constitution any amendment to the Constitution incidental to or consequential on the exercise of any power to make law conferred on Parliament by any provision of the Constitution, other than Articles 74 and 76 is excepted from the provisions of Clause (3) of Article 159: NOW, THEREFORE, IT IS ENACTED by the Parliament of Malaysia as follows: Short title and commencement 1. (1) This Act may be cited as the Capitation Grant Act 2002. (2) This Act shall be deemed to have come into operation on 1 January 2002. 6 Laws of Malaysia ACT 622 Amendment of Part I of the Tenth Schedule to the Federal Constitution 2. Subsection 1(1) of Part I of the Tenth Schedule to the Federal Constitution is amended by substituting for paragraphs (a), (b), (c) and (d) the following paragraphs: “(a) for the first 100,000 persons at the rate of RM72.00 per person; (b) for the next 500,000 persons at the rate of RM10.20 per person; (c) for the next 500,000 persons at the rate RM10.80 per person; (d) for the remainder at the rate of RM11.40 per person,”.
