Prevention of difficulties or anomalies 5 LAWS OF MALAYSIA Act 547 PERBADANAN PEMBANGUNAN BANDAR (DISSOLUTION) ACT 1996 An Act to repeal the Perbadanan Pembangunan Bandar Act 1971, to dissolve the Perbadanan Pembangunan Bandar established under the Act and to provide for matters connected therewith. [1 September 1996, P.U. (B) 343/1996] BE IT ENACTED by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: Short title 1. This Act may be cited as the Perbadanan Pembangunan Bandar (Dissolution) Act 1996. Interpretation 2. In this Act, unless the context otherwise requires— ―Government‖ means the Government of Malaysia; ―Minister‖ means the Minister responsible for urban development; ―Perbadanan‖ means the Perbadanan Pembangunan Bandar established under the Perbadanan Pembangunan Bandar Act 6 Laws of Malaysia ACT 547 1971 [Act 46]. Repeal and dissolution 3. The Perbadanan Pembangunan Bandar Act 1971 is repealed and the Perbadanan established thereunder is dissolved. Savings 4. (1) Notwithstanding the repeal under section 3, all (a) powers; (b) rights; (c) privileges; (d) duties; (e) liabilities; and (f) obligations, under section 18 of the Perbadanan Pembangunan Bandar Act 1971 which immediately before the commencement of this Act were those of the Perbadanan shall, on the commencement of this Act— (aa) devolve on the Government; and (bb) be exercised in accordance with any written law for the time being in force relating to— (aaa) town and country planning; and (bbb) tax, rent, rates or other charges with respect to property. Perbadanan Pembangunan Bandar (Dissolution) (2) 7 Any— (a) planning permission, approval for development, or approval of a building plan granted in respect of any land; and (b) instrument or document issued, by the Perbadanan by virtue of its power under section 18 of the repealed Act, shall continue to have force and effect and shall be deemed to have been granted or issued by the Government by virtue of the operation of subsection (1) until the same is amended, modified, revoked or cancelled by the Government. Prevention of difficulties or anomalies 5. (1) If any difficulty or anomaly arises in connection with the implementation of the provisions of this Act, the Minister may by order make such modifications therein as may appear to him necessary for removing or preventing such difficulty or anomaly.
