TITLES OF OFFICE ACT 1949
An Act relating to the changing of the titles of public offices, public
bodies and Government Departments.

Short title
1. This Act may be cited as the Titles of Office Act 1949.
Interpretation
2. In this Act, unless the context otherwise requires—
“federal law” means an Act of Parliament, and any other law in force
in Malaysia or any part thereof which relates to a matter with respect
to which Parliament has power to make laws;
* “Peninsular Malaysia” has the meaning assigned thereto by section
3 of the Interpretation Acts 1948 and 1967 [Act 388], and includes the
Federal Territory;
“public office” means an office in any of the public services
mentioned in Clause (1) of Article 132 of the Federal Constitution and
“federal public office” means an office in any of the public services

mentioned in paragraphs (a) to (f), both inclusive, and in paragraph (h),
of that Article.
Substitution of new titles
3. (1) Wherever any title amongst those of the public offices set out
in the first column of the First Schedule appears in any written law or
in any notification made thereunder, it shall be deemed to be replaced
by the corresponding title or titles set out in the second column of such
Schedule.
(2) In the application of this section to Sabah and Sarawak “written
law” means federal law, in force in those States, respectively.
Provision for further changes
4. Whenever any change of title of any public office or of any public
body or of any Department of any Government in Malaysia occurs, the
Yang di-Pertuan Agong may, if occasion requires, by notification in
the Gazette, make any necessary substitution in or addition to the First
Schedule, and section 3 shall apply accordingly in conformity with
every such substitution or addition:
Provided that—
(a)
in the application of this section to Peninsular Malaysia,
in the case of a public office, appointment to which does
not involve liability to serve in more than one State, any
such notification may be made only with the concurrence
of the State Authority concerned; and
(b) in the application of this section to Sabah and Sarawak,
any such notification may be made only in relation to a
change of title of—

(i)
a federal public office; or
(ii)
a public body established by or under federal
law or exercising exclusively federal functions;
or
(iii)
a Department of the Government of Malaysia.
Amendment, repeal and saving
5. The Ordinances and Enactments set out in the Second Schedule are
hereby amended or repealed to the extent specified in the third column
of the said Schedule, but without prejudice to any change of title
effected by or under any such Ordinance or Enactment.
