NATIONAL DEFENCE FUND
(DISSOLUTION AND TRANSFER) ACT 1984
An Act to dissolve the National Defence Fund and to transfer all its
properties and liabilities to the National Heroes Welfare Trust Fund,
and to provide for matters incidental thereto or connected therewith.

WHEREAS the trustees of the National Defence Fund have decided
to dissolve the said Fund and transfer all its properties and liabilities
to the National Heroes Welfare Trust Fund, such properties to be held
in trust and utilized in accordance with the terms and for the
purposes, as may for the time being, be set out in the Instrument of
Trust in respect of the National Heroes Welfare Trust Fund;
AND WHEREAS the Managerial Board of the National Heroes
Welfare Trust Fund has decided to accept such transfer;
Now therefore BE IT ENACTED by the Seri Paduka Baginda Yang
di-Pertuan Agong with the advice and consent of the Dewan Negara
and Dewan Rakyat in Parliament assembled, and by the authority of
the same, as follows:
Short title
1. This Act may be cited as the National Defence Fund (Dissolution
and Transfer) Act 1984.
Interpretation
2. In this Act, unless the context otherwise requires—

“National Defence Fund” means the Fund maintained in the
National Defence Fund Trust Account established under section 9 of
the Financial Procedure Act 1957 [Act 61];
“National Heroes Welfare Trust Fund” means the trust fund so
named which is maintained and managed under an Instrument of
Trust executed on 31 October 1968 between the Managerial Board of
the said Trust Fund of the one part and the Public Trustee, Malaysia
of the other part.
Dissolution of the National Defence Fund and transfer of its
assets and liabilities to the National Heroes Welfare Trust Fund
3. (1) The National Defense Fund shall, on the commencement of
this Act, be dissolved and all moneys, securities and other assets
standing to its credit in the trust account maintained in respect of it
under section 9 of the Financial Procedure Act 1957, or otherwise
belonging to or due to be paid into the said Fund, immediately before
the commencement of this Act shall, on the commencement of this
Act, be transferred to the National Heroes Welfare Trust Fund and
vest in the trustee of the said Trust Fund, and such transfer and
vesting shall have effect without any document of transfer,
conveyance or assignment whatsoever.
(2) The moneys, securities and other assets transferred under
subsection (1) shall be held in trust and utilized under the National
Heroes Welfare Trust Fund in accordance with the terms and for the
purposes, as may for the time being, be set out in the Instrument of
Trust in respect thereof.
(3) All rights and liabilities which immediately before the
commencement of this Act were those of the National Defence Fund
shall, on the commencement of this Act, devolve on the National
Heroes Welfare Trust Fund.
