Saving of rights 4 Laws of Malaysia ACT 108 Good Shepherd Nuns (Incorporation) 5 LAWS OF MALAYSIA Act 108 GOOD SHEPHERD NUNS (INCORPORATION) ACT 1973 An Act to incorporate the Sister Superior of the Good Stepherd Nuns in Malaysia. [22 June 1973] BE IT ENACTED by the Seri Paduka Baginda Yang di-Pertuan Agong with the advice and consent of the Dewan Negara and Dewan Rakyat in Parliament assembled, and by the authority of the same, as follows: Short title 1. This Act may be cited as the Good Shepherd Nuns (Incorporation) Act 1973. Incorporation of the Sister Superior of the Good Shepherd Nuns in Malaysia 2. (1) Sister Joan Gormley, the Sister Superior of the Good Shepherd Nuns in Malaysia and her successors in office, shall be a body corporate by the name of “the Sister Superior of the Good Shepherd Nuns, Malaysia”, in this Act referred to as “the Corporation”. (2) The Corporation may enter into contracts and may acquire, purchase, take, hold and enjoy movable and immovable property of every description and may convey, transfer, assign, surrender and yield up, charge, mortgage, demise, reassign or otherwise dispose of, or deal with, any movable or immovable property vested in the Corporation. (3) The Corporation may sue and be sued in respect of its property and otherwise in all courts of justice and in all matters and suits. 6 Laws of Malaysia ACT 108 Common seal of the Corporation 3. (1) The Corporation shall have a common seal and such seal may from time to time be broken, changed, altered and made anew as to the Corporation seems fit. (2) No deed, document or other instrument sealed with the seal of the Corporation shall be deemed to be duly sealed unless— (a) such seal has been affixed in the presence of the Sister Superior for the time being in office, or her attorney duly authorized by a power of attorney registered under the Powers of Attorney Act 1949 [Act 424]; and (b) such deed, document or other instrument is signed by the said Sister Superior for the time being in office or her attorney so authorized as aforesaid. (3) Such signing shall be and be taken as sufficient evidence of the due sealing of such deed, document or other instrument. Notification of appointment of Sister Superior 4. A notification in the Gazette of the appointment of any person to hold, or act in, the office of Sister Superior of the Good Shepherd Nuns in Malaysia shall be conclusive evidence that such person was duly authorized and appointed. Vesting of property 5. All movable and immovable property situated in Malaysia heretofore held for and by, conveyed, assigned, granted, leased, transferred, transmitted to or otherwise vested in the Sister Superior of the Good Shepherd Nuns in Malaysia is vested in the Corporation for the purposes of this Act and subject to the rules for the time being of the Corporation. Saving of rights 6.
