[15 September 1954] Short title 1. This Act may be cited as The Visitor in the Federation of Malaya of the Christian Brothers’ Schools (Incorporation) Act 1954. Interpretation 2. In this Act, unless the context otherwise requires— “Corporation” means The Visitor in the Federation of Malaya of the Christian Brothers’ Schools as incorporated under section 3; “holder of the office” means Reverend John Kennedy generally known as Brother Barnitus who was appointed by an instrument under the hand and seal of the Superior General of the Society of Christian Brothers to the office of “The Visitor in the Federation of Malaya of the Christian Brothers’ Schools” and includes his successors in office. 6 Laws of Malaysia Act 816 Incorporation of The Visitor in the Federation of Malaya of the Christian Brothers’ Schools 3. (1) The holder of the office of The Visitor in the Federation of Malaya of the Christian Brothers’ Schools shall be a body corporate by the name of “The Visitor in the Federation of Malaya of the Christian Brothers’ Schools” and shall have perpetual succession and a common seal. (2) The Corporation may sue and be sued in its name. (3) The Corporation may— (a) enter into contracts; (b) acquire, purchase, take, hold and enjoy movable and immovable property of every description; and (c) sell, convey, assign, surrender, yield up, charge, mortgage, demise, reassign, transfer or otherwise dispose of, or deal with any movable or immovable property vested in the Corporation upon such terms as the Corporation thinks fit. Common seal 4. (1) The Corporation shall have a common seal which may be broken, changed, altered and made anew as the Corporation thinks fit. (2) Until a seal is provided under this section, a stamp bearing the inscription “Visitor in the Federation of Malaya of the Christian Brothers’ Schools” may be used as the common seal of the Corporation. (3) No deed, document or other instrument sealed with the seal of the Corporation shall be deemed to be duly sealed unless— (a) the seal has been affixed in the presence of the holder of the office or his attorney duly authorized by a power of attorney registered under the Powers of Attorney Act 1949 [Act 424]; and The Visitor in the Federation of Malaya of the Christian Brothers’ Schools (Incorporation) 7 (b) the deed, document or other instrument is signed by the holder of the office or his attorney. (4) The signing of the deed, document or other instrument shall be sufficient evidence of the due sealing of the deed, document or other instrument. Appointment of holder of the office 5. A notification in the Gazette of the appointment of any person to hold, or act as the holder of the office shall be conclusive evidence that such person was duly appointed. Vesting of property 6.
